With respect to the processing of personal data, WK Advocaten is processing responsible within the meaning of the AVG. This means that WK Advocaten chooses which personal data are processed and determines the purpose for such processing and the manner in which the data are processed. WK Advocaten is responsible for the proper and careful processing of your personal data.
What personal data will be processed?
The following personal data will be processed in any event upon entering into this engagement:
- Surname and first name(s);
- Address, postal code and place of residence
- Telephone number;
- E-mail;
- Date and place of birth;
- Nationality;
- Marital status;
- BSN number
- Source of income (work/benefit).
The above data relates to both you and your partner, if any.
In the handling of your case, only the personal data relevant to this will be processed. Depending on the content of your case, more or less data may be needed to properly assist you. Some data are more sensitive than others. Think of data relating to your health, such as medical records. Naturally, this is handled appropriately and carefully, and appropriate electronic and physical security methods are applied to prevent breaches.
Basis and processing purposes
Your data will only be processed for the performance of this assignment and further with your specific, targeted and informed consent given prior to the processing. If WK Advocaten requests personal data from you or a third party, you will be informed in advance of the purpose and your consent will be sought for this.
Your personal data will not be shared with third parties unless you give targeted, informed and specific consent to do so or instruct us to do so yourself. However, in the context of proceedings, the handling of your case and the proper execution of this assignment, your data may be provided to the parties involved. You will be informed in advance.
Retention period
WK Advocaten is obliged to comply with the statutory retention and limitation periods such as the General Act on State Taxes (AWR), the Civil Code and the Regulation on the Legal Profession (Voda). Records and data carriers are therefore kept in accordance with the statutory period:
Limitation period for legal action requesting documents: 5 years after end of involvement in the case
Retention period of administrative data: 7 years
Retention period pursuant to the AWR: 7 years
Privacy and rights
Our processing of your personal data is subject to the General Data Protection Regulation (AVG). Under the AVG, you have the following rights:
- right to receive an explanation from us about what personal data we hold and what we do with it;
- to have access to the personal data relating to you that we hold;
- to have errors corrected or additions made;
- having outdated personal data deleted;
- withdrawing your consent to the processing of personal data by us.
Right of objection
In particular, we would also like to remind you of your right to object to any particular use of your personal data.
If you wish to exercise the above rights, please contact us. When doing so, always indicate who you are. This will prevent the personal data of the wrong person from being amended or deleted.
